It should be there before you start the program. as having it there before having to run the program is more of a courtesy thing towards the users. Pretty much, you include a file with the .exe that is named LICENSE, and just paste the contents of the license you choose into that file.
You'll need to also be sure to include that license file when you distribute, but that's not hard at all if you pack everything in a zip file before uploadingl.

Most if not all licenses cover the if-it-breaks-it's-on-you angle, but I do really recommend having a formal license in place. If you want to match Sandbox, IIRC it uses the zlib/png license, so you might want to take a look at that.
