A question That I really need a question to. LIKE A BOSS.

Postby AbstractLord » March 30th, 2012, 2:12 pm

Well, I'm developing a small Lovecraft game, and I was wondering if I could sell it. It DOES NOT involve:
Cthulhu, Nyarlethotep.
But It DOES involve a Lovecraft-ian space monster. Named Bill.
Can I sell it, or is anything associated with Cthulhu copy-right?

I Am Not A Lawyer. But, basically things that are assembled in a particular way can be copyrighted, but the underlying ideas behind them cannot. In other words, simply taking the idea of a Lovecraftian character, without the name or actual attributes or characteristics, then running it through your own set of circumstances would be acceptable. Actually using Cthulhu or a description that could be attributed to Lovecraft's Cthulhu would be crossing the line.

Your best bet would be to consult a lawyer or someone better versed in copyright law.

LeafClaw asked a similar question about the book series "Warrior Cats", like Tyche said it's best that you use a basic idea and put your own spin on it.

being a business minor and a Law Major at college, I'll try to answer your question.

You have a Love craft like game with a monster that is like one in the other game.
Legally here's what you do.

Make sure the name of your game is different
Make sure the story of your a game has some major differences to the other game (example: boy find girl, boy lose girl, boy rescue girl from girl eating monster.) These stories are all the same but how the story unfolds can be different from one to another.

also make sure this boss monster is different from the love craft one. different texture, or size etc and name.

people may see it a copy but in legal terms you just followed the rpg, mmorpg, whatever template you were following to make a style of game. then you can sell it.

I'm proud to be a :ugeek:

save the girl. kill the creature, get back home for dinner.
